1. OVERVIEW

Welcome to Artistic Puzzles (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and related services (collectively, the “Services”).

Our store is powered by Shopify, Inc., which provides the e-commerce platform that enables us to sell products to you. However, all sales transactions are between you and Artistic Puzzles directly.

By accessing, browsing, or purchasing from our Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

2. ELIGIBILITY

You represent and warrant that:

• You are at least the age of majority in your jurisdiction
• You have legal capacity to enter into binding agreements
• All information you provide is accurate and complete

We reserve the right to refuse service to anyone at our discretion.

3. MADE-TO-ORDER PRODUCTS & FINAL SALE POLICY

All Artistic Puzzles products are custom printed on demand.

Production begins shortly after an order is placed.

By placing an order, you expressly acknowledge and agree that:

• Your item is manufactured specifically for you
• Orders cannot be returned for change of mind
• Orders cannot be returned for buyer preference
• Orders cannot be returned due to incorrect selection made by the customer
• Minor color variations due to screen display differences do not constitute defects
• All sales are final once production begins

Your purchase is subject only to the limited remedies described in our Refund & Returns Policy.

4. ORDER ACCEPTANCE & CANCELLATION

Your submission of an order constitutes an offer to purchase.

We reserve the right to accept, decline, limit, or cancel any order for any lawful reason, including suspected fraud or pricing errors.

Orders may only be canceled or modified before production begins. Once production has started, orders cannot be changed or canceled.

We are not responsible for errors made by customers during checkout, including incorrect shipping addresses or product selections.

5. PRICING, TAXES & PAYMENT

All prices are listed in U.S. Dollars unless otherwise specified.

Prices are subject to change without notice.

You agree to provide current, accurate billing information. You represent that:

• You are authorized to use the submitted payment method
• Charges will be honored by your financial institution

You are responsible for applicable taxes and shipping charges.

We reserve the right to refuse or cancel orders in cases of pricing errors.

6. SHIPPING & DELIVERY (UNITED STATES & CANADA ONLY)

We ship only within the United States and Canada.

Orders placed outside these territories may be canceled at our discretion.

Delivery times are estimates and not guarantees.

Title and risk of loss transfer to you when the product is delivered to the shipping carrier.

We are not responsible for:

• Carrier delays
• Weather disruptions
• Customs processing
• Packages marked as delivered by the carrier
• Lost or stolen packages after confirmed delivery

If tracking confirms delivery, the order is considered fulfilled.

7. PRODUCT REPRESENTATION

We strive to accurately display product images and colors. However:

• Display colors may vary by device
• Lighting and monitor settings affect appearance
• Printed products may differ slightly from digital previews

Such differences do not constitute defects.

8. INTELLECTUAL PROPERTY RIGHTS

All artwork, puzzle designs, graphics, branding, text, and digital content are owned by Artistic Puzzles and protected under U.S. copyright, trademark, and intellectual property laws.

You may not:

• Reproduce
• Distribute
• Modify
• Create derivative works
• Use our content commercially

Unauthorized use may result in legal action.

9. PROHIBITED USES

You may not use the Services:

• For unlawful purposes
• To infringe intellectual property rights
• To engage in fraud or chargeback abuse
• To interfere with website security
• To transmit malware

Violation may result in termination of access.

10. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

All Services and products are provided “AS IS” and “AS AVAILABLE.”

We disclaim all implied warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement

We do not guarantee uninterrupted or error-free service.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

Artistic Puzzles shall not be liable for:

• Indirect damages
• Consequential damages
• Lost profits
• Loss of data
• Emotional distress

Our total liability shall not exceed the purchase price of the product in dispute.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Artistic Puzzles, its affiliates, service providers, and Shopify from any claims arising from:

• Your breach of these Terms
• Your violation of law
• Your misuse of the Services

13. DISPUTE RESOLUTION & BINDING ARBITRATION

PLEASE READ CAREFULLY.

Any dispute arising out of or relating to these Terms, the Services, or products purchased shall be resolved exclusively through binding arbitration in the United States under the rules of the American Arbitration Association.

You agree:

• Arbitration is individual only
• Class actions are waived
• Jury trial is waived

This clause survives termination.
